When most people think about IRS garnishment they typically think about their wages being levied. Unfortunately, that’s only one of many things the IRS can garnish. Basically, they can levy just about any income or financial account or attach a lien to any physical or real property that they want to. Nothing you have is safe from the IRS unless you know how to protect yourself.

Most people are familiar with the fact that the government can garnish wages or salaries. A notice is sent to your employer and money is taken directly out of your paycheck. But that’s not the only way that the IRS can get your money. They can also take your commissions and, if you have a business, your accounts receivable. In addition to that, if you have rental property they can levy your rental income. The interest and dividends you might receive from bank accounts or brokerage accounts can be garnished too. In fact, just about any stream of income you have coming in can be levied.

But they might take more than just the interest and dividends.

The Most Feared Government Institution

To even mention the name of this government institution can set off waves of anxiety and stories of abuse and persecution that is unheard of for virtually any other governmental body in this country.  It’s really amazing the ability of three little words to instill fear in the hearts of an American citizen when those three little words are – Internal Revenue Service.

When we look a little closer at the mission of the IRS and their actual record of how they handle most of their cases, the level of hysteria we get ourselves into is really pretty silly.  For the most part, the abuses and draconian methods that we think of when we talk about the IRS are urban myth.  You would think that the IRS existed solely to imprison the American people, take all of their property and make our lives miserable either through audits that resemble the Spanish Inquisition or by keeping us all in constant terror.

This is not to say that over the decades there have not been some abuses that have earned the IRS as least some of the reputation it is still working to live down.

It Could Happen to Anyone

Jon had worked a regular job for regular wages and had the regular amount taken out of his paycheck for taxes, just like everyone else. He thought that people who had tax problems and faced IRS wage garnishment must be doing something sneaky or tricky that got them into trouble. Jon couldn’t have been more wrong, as he was about to find out.

Jon had been working for the same company for five years, since he had graduated from high school. It was a tough job — construction — but his boss liked him and made sure to find work for Jon even when others were being laid off. He took a part-time second job to make some extra money to pay off his three-year-old pickup truck and to pay down his credit card debt. His buddy, Paul, had a business that put up drywall and they had more work than they could handle. He hired Jon to come in a few evenings a week and on Saturdays to help out his regular crew.

It was a perfect win-win situation: Jon got some extra cash and Paul could have an extra pair of hands without the expense of hiring another employee.

Around the end of January, amongst the bank statements and credit cards bills, Jon noticed something odd.
